Teacherís Right to Remove a Student

Attached you will find a memo to Unit 1 members for distribution regarding student removal from a classroom. As some of you have reported, some administrators seem to be confused about a teacherís right in this regard. This memo is meant to clarify the student removal process:

1. The absolute right for a teacher to remove a student from class is guaranteed in the Unit 1 Contract and the language has been included in the memo.

2. The relevant language supporting a teacherís right to student removal from New York Education Law Section 3214 has also been provided.

3. The process can also be found in the SCSD 2015-2016 Code of Conduct on pages 38-40.

In the memo we ask members to document incidents where administrators have not supported the process for student removal after a follow up conversation with the member. Chief Reps should put these incidents on the Labor Management Team Agenda and/or the Discipline/Climate Team Agenda for discussion and resolution. If no resolution is possible at the building level, please notify this office immediately.
